Product Exchange and Return Policy

 

 

In compliance with consumer protection and protection legislation, Aero Arte® makes available two (2) modalities of exchange or return of products: for Consumer's regret; and by default of the product.   

 

1.   Repayment or Exchange for Consumer Repudiation (within legal deadline)

If you are not satisfied with your purchase, the Consumer may request a return   of products within 7 (seven) calendar days after receipt of the order. If the deadline expires on a Saturday, Sunday, or holiday, Customer may report the repurchase by the first business day thereafter. To open a return order, the customer must send an email to   contato@aeroarte.art.br.  

 

2.   Repayment or Repurchase of Consumer (outside the legal term)

In addition to the 7 (seven) days provided for in the Consumer Defense Code, Aero Arte® also allows the cancellation of purchases   or exchanges within 30 (thirty) calendar days from the date of receipt of the Product. In this case, all the conditions indicated in item 1 above apply, however, the Customer shall bear the costs of shipping the Product.  

 

3.   Return or Default Product Change  

If the product is defective, the Consumer may request a return   or exchange of the defective product within 30 (thirty) days after receipt of the order.   If the deadline expires on a Saturday, Sunday, or holiday, Customer may report the repurchase by the first business day thereafter. To open an exchange or return request, the customer must send an email to   contato@aeroarte.art.br.

Refund Policy

If you are not satisfied with your purchase, the Consumer may request full refund within 7 (seven) calendar days after receipt of the order. If the deadline expires on a Saturday, Sunday, or holiday, Customer may report the repurchase by the first business day thereafter. To open a refund request, the customer must send an email to   contato@aeroarte.art.br.

Shipping Policy

 

1. Confection Time

Aero   Arte® makes available in its virtual store some products that are made after the purchase order, so the posting is done in   up to five (5) business days after confirmation of payment.

 

2. Delivery Time 
During the Purchase process, Aero Arte® will inform the Customer of an estimate of the term for the delivery of the Products. This estimate takes into account the products purchased, their quantities, the available inventory and the distance between our   central  distribution address and the delivery address informed by the Customer. The delivery period will be counted from the date of approval of the request, which can occur in up to 3 (three) business days for payments by credit card or ticket.   

 

3. Freight Amount

The freight value of the delivery of the Products is calculated automatically by the Site at the time of Purchase, based on the weight, volume and quantity of the Products purchased, as well as the distance between our   center   and the place of delivery informed by the Customer. At its sole discretion , Aero Arte® may make available on its Website special freight categories, specific to some products and to some locations, either permanently or temporarily. In this case, it is possible that each category offers different prices and delivery times, and it is up to the Customer to select the category that meets their expectations.

In case the User requires any information, clarification or assistance regarding this Privacy and Security Policy, Aero Arte® makes available the communication channels listed below:   a) By e-mail contato@aeroarte.art.br, and b) By   telephone +55 41-9711-9491, from Monday to Friday, from 08:00 to 18:00, always accompanied by the contact information of the Consumer, so that we can finalize the service. In all cases, the User will receive, through the same channel of communication, an immediate confirmation of the receipt of his demand, which will be processed and answered within a maximum period of 5 (five) days. In addition, Aero Arte® makes available on this site a FAQ (Frequently Asked Questions) section, as well as its other policies: Exchange and Returns Policy, Product Delivery Policy, and, finally, the Terms and Conditions of Use of this Site . All these documents can be consulted online or downloaded by users in PDF format for offline consultation and archiving.   

 

3. General information   

Aero Arte® takes all necessary measures to protect the privacy of the User, in compliance with the legislation in force. This document details the ways of collecting, storing, using, sharing and disseminating your personal data, as well as clearly indicating the measures taken to ensure the protection of the data collected.   

 

4. Collection, use and storage of data

Data Collection: Access Account. For the creation of an Access Account on the Site, the User must fill out a registration, which may vary in complexity according to the operations that you intend to do. In this way, a simple register composed of e-mail address and zip code will be required to send advertising and promotional messages to the User about products, services, promotions and / or news of Aero Arte®. To perform Purchases, the User must create a Full Access Account, providing full name, email address, telephone number, CPF, full address (state, city, neighborhood, street, number, add-on, extra information) . The data provided by the Users will be stored and used by Aero Arte® by you or by third parties contracted by you, to provide the products of the Site, to carry out business transactions, to process related payments, to share data, to send offers emails products, services and marketing campaigns, store history of products viewed, promote retargeting campaigns , customize Site pages, verify bank details to avoid fraud (data will not be stored) and make deliveries and returns. The data may be shared with third parties contracted by Aero Arte®   pursuant to this Policy, it being understood that the creation of each Access Account or any registration in the Site, for which it is necessary to send any personal data of the User, presupposes the express consent regarding the collection, use, storage and treatment of personal data. The User is responsible, in the civil and criminal spheres, for the veracity and updating of the data provided (including personal data) and Aero Arte® disclaims any liability for damages resulting from incomplete, inaccurate or inaccurate any means or form or by the use of such record in an improper way by any third party not authorized to use such data or also by third parties having, due or  improperly obtained the User data to access the Site, acting as if it were.

Use of data: E-mail. Aero Arte® will use the User's e-mail as a priority to send information about its Purchases (purchase confirmation and updates of the situation). The registered e-mail will also be used to recover the access password of the Client, in case of loss or forgetting the password.

Use of data: Advertising via direct mail, email, MMS or SMS. At the time of registering your contact information, the User will have the option to accept or prohibit the sending of advertising messages. In addition, at any time, the User may change his decision, through access to his Account on the Site or contact our Customer Service   or in the field of descadastro existing in the newsletters sent by Aero Arte®, in which case the unsubscribing of the database may take up to 5 (five) days to be effective.

Use of data: Other forms. In addition to the forms set forth above, Aero Arte® may, in its sole discretion, use the User's personal data in the following ways: (i) updating the registration; ( ii ) security of the User; ( iii ) response to requests from the User; ( iv ) information about changes in the Terms and Conditions of Use or the Policies; (v) preparation of statistics regarding the use of the Site, guaranteed the anonymity of the User, including for purposes of improvement and understanding of the Users' profile for the improvement of the Site; (vi) improvement of interactivity tools between the Site and the User, guaranteeing their anonymity; ( vii ) compliance with court orders; and ( viii ) defense of Aero Arte® rights against the User in judicial or administrative proceedings.

Data storage. Aero Arte® will keep all data collected in your protected and secure databases. Such data will be accessed only by computerized automated processes, authorized professionals and in the cases listed in this Policy. In case the User requires the exclusion of his / her data from the database, Aero Arte reserves the right to keep the data in question in backup copies for up to 6 months in order to comply with mandatory legal obligations .   

 

5. Sharing and dissemination of data

Aero Arte® has the confidentiality of your personal data as a priority in your business. Thus, it undertakes not to disclose, share, give access to, facilitate access to, rent, sell, exchange or otherwise make such information available to third parties, under any pretext, except in cases expressly authorized by the User, including in cases indicated below.   For the sole purpose of enabling Purchases to be made on the Site, Aero Arte® may share personal data of Users with its trading partners, such as payment processing companies, credit card companies and carriers. In this case, only the personal data that is essential will be shared so that the commercial partner of Aero Arte®   activity (collection, delivery, etc.). In addition, such trading partners will be required, by means of confidentiality agreements, not to archive, keep on file, compile, copy, reproduce or share such data with anyone.    The other possibility of disclosure of personal data is by means of a judicial determination. Also in this case, the disclosure will occur only to the extent necessary to comply with the court order, and the data not required by the authority in question remain confidential.   

 

6. Data transmitted without request from Aero Arte®

Aero Arte®   asks the User not to send to Aero Arte® any commercial information, personal creations, ideas, photographs, projects, concepts, etc. ( Unclaimed Content). Such Unsolicited Content will be summarily discarded without any reading or incorporation into Aero Arte® databases. Under the Copyright Law, ideas, abstract conceptions, projects, plans and schemes are not susceptible of protection in Brazil. In this way, any use by Aero Arte® of any Unsolicited Content will be due to internal and independent development and may occur freely, not being due or required any authorization or compensation to the user or consumer. Aero Arte® independently develops all its policies and activities, rejecting already any accusation or claim of exploitation of Unsolicited Content.

 

7. Security measures   

Technological resources. Aero Arte® adopts advanced technological resources to ensure the security of all personal data collected and stored. Not even Aero Arte® employees have free access to the Users database, which is limited to those whose functions require the contact with personal data. Among the security measures implemented are the use of modern forms of encryption and the installation of barriers against improper access to the database (firewalls). Such measures can be verified by the User accessing the Site by viewing the "security lock" in your internet browser.

Password secrecy. Aero Arte® recommends that the User keep his password in full secrecy, avoiding its disclosure to third parties. Aero Arte® will never ask the User to inform you of your password outside the Site, by telephone, e-mail or any other means of communication. The User password must be used exclusively at the time of accessing the User Account on the Site. If the User suspects that his password has been exposed to third parties, Aero Arte® recommends the immediate replacement of the password.

Suspicious emails. Aero Arte® sends the User only e-mails with advertising messages, advertising products and services or updating information. Aero Arte® does not send messages (i) requesting personal data of the User; ( ii ) requesting the User's password or financial data; ( iii ) with attached files except PDF documents; or ( iv ) with download links for files. If you receive an email with such characteristics, disregard it and contact our Customer Service.

Credit cards. Aero Arte® does not store user financial information in its database, such as credit card information. The payment approval procedure occurs between the User, the banks and the card administrators, without Aero Arte® intervention.

Impossibility of accountability. Despite Aero Arte®'s greatest efforts, the current state of the art does not allow the creation of an absolutely secure database against attacks . In this way, Aero Arte® will not be liable for any damages caused by third parties, including for invasions of the Site or the database, for viruses or for information leakage, unless Aero Arte®'s sole fault is proven .

 

8. People's rights to collected data

Aero Arte® allows the User to make different types of registration, containing more or less information according to their own purpose in the Site. Thus, the User has the possibility to choose the form of registration, and must fill it with true and updated information. The User declares that he is the legitimate holder of his personal data and may at any time use the tools of the Site to edit, update or remove them from our database. Aero Arte® will keep the data preventively removed for a period of six months in order to comply with mandatory legal obligations, definitively discarding them after such period. Aero Arte® also provides tools so that the User can determine some uses of his personal data, such as the authorization to send advertising pieces.   

 

9. Use of data in case of change of control of Aero Arte®

The data collected may be eventually transferred to a third party in the event of a change in control, acquisition, merger or sale of Aero Arte® assets in any medium or form.
